PW Time Tracker — Terms of Service

1. What this product is

The PW Time Tracker ("the App") is a time tracking application built and sold by J9 Systems LLC ("J9 Systems," "we," "us"). The App allows construction contractors to record employee clock events (clock in, clock out, site check-in, breaks) with GPS coordinate capture, categorize hours by job and rate type (prevailing wage vs. non-prevailing wage), and export time data for use by the customer's payroll provider.

2. What this product is not

The App is a time tracking tool. It is not payroll software. It does not calculate wages, withhold taxes, generate paychecks, or produce certified payroll reports (such as WH-347 forms). It does not provide legal, tax, accounting, or compliance advice. The data the App produces is intended to be reviewed by the customer and processed by the customer's payroll provider, accountant, or compliance officer.

3. Customer responsibilities

Data review. The customer is responsible for reviewing all time data before processing payroll. The App provides tools (admin dashboard, GPS map pins, time card review) to help with this. J9 Systems is not responsible for payroll errors resulting from unreviewed or incorrectly reviewed data.

Rate classification. The customer is responsible for correctly configuring which jobs are prevailing wage and which are not. The customer is also responsible for determining the correct prevailing wage rates for their jurisdiction, contract, and trade classifications. The App applies the rates the customer enters. J9 Systems does not determine or verify prevailing wage rates.

Employee notification. The customer is responsible for notifying their employees that GPS coordinates are captured during clock events, in accordance with applicable state and federal laws. J9 Systems provides a template employee notification as part of the onboarding package.

Compliance decisions. Prevailing wage and Davis-Bacon rules vary by federal law, state law, and individual contract terms. The customer is responsible for understanding and applying the rules that apply to their specific projects. The customer should consult their attorney or compliance advisor for classification questions.

4. GPS data and employee privacy

The App captures GPS coordinates at the time of each clock event (clock in, clock out, site check-in, break start, break end). The App does not continuously track employee location. Coordinates are captured as one-time events only when the employee initiates an action in the App. GPS data is stored securely and is accessible only to the customer's authorized administrators.

5. Ownership and licensing

Upon full payment of the one-time purchase price, the customer owns their instance of the App and all data stored within it. There are no ongoing licensing fees, per-seat charges, or subscription costs. J9 Systems retains ownership of the underlying codebase and may use the same architecture to build applications for other customers.

6. Setup and configuration

The purchase price includes initial setup and configuration: loading the customer's jobs, rate schedules, employee roster, and branding (logo and colors). Additional customization beyond the standard configuration (custom features, integrations, or workflow changes) is available at an additional cost, scoped and quoted separately.

7. Support and updates

J9 Systems provides 30 days of post-launch support at no additional cost. This includes bug fixes, configuration adjustments, and usage questions. After the initial 30-day period, support is available on a time-and-materials basis or through a separate support agreement.

8. Data accuracy and limitations

The accuracy of time data depends on correct usage by employees and administrators. If an employee fails to clock in, clocks in at the wrong location, or skips a site check-in, the resulting data will be incomplete or inaccurate. The admin dashboard provides tools to identify and correct these issues before exporting data for payroll. J9 Systems is not responsible for errors caused by incorrect or incomplete employee usage.

9. Limitation of liability

To the maximum extent permitted by law, J9 Systems' total liability arising from or related to the App is limited to the purchase price paid by the customer. J9 Systems is not liable for any prevailing wage violations, DOL penalties, back wage assessments, legal fees, or other compliance-related costs incurred by the customer, regardless of cause. The customer assumes full responsibility for compliance with all applicable prevailing wage, Davis-Bacon, and labor laws.

10. No warranty of compliance

The App is designed to help contractors track time more accurately. J9 Systems does not warrant or guarantee that use of the App will result in compliance with prevailing wage laws, Davis-Bacon requirements, or any other federal, state, or local regulations. Compliance depends on correct configuration, correct usage, and the customer's adherence to the laws that apply to their specific contracts and jurisdictions.

11. Governing law

These terms are governed by the laws of the State of California. Any disputes will be resolved in the courts of the State of California.
